01 · The Eviction
A Year After Foreclosure, the Sheriff Came
U.S. Bank foreclosed on the Summers’ Oakville home in February 2011. Fourteen months later, the family was still living in it. In January 2012 the Federal Home Loan Mortgage Corporation went to St. Louis County court to get them out.
The case was classified as a landlord action. A consent judgment was entered on February 22, 2012, and on April 19 the county sheriff’s eviction unit executed it. The docket records the outcome in three words: “Evicted by Court.”

02 · Two Foreclosures
Two Houses, Two States, Three Months Apart
The Summers owned a house in Minnesota when John Summers took a job in St. Louis in 2007 and the couple bought a second home in Oakville. By late 2010 they were keeping up with neither.
Their own bankruptcy schedule lists the Minnesota house foreclosed in December 2010 ($132,000) and the Missouri house foreclosed February 4, 2011 ($219,000). A Toyota Sequoia was repossessed a month before the first foreclosure.

03 · Seven Late Tax Bills
Late on Personal Property Taxes in Seven of Nine Years
Missouri personal property taxes are due December 31. St. Louis County records show the Summers household paid after the deadline for tax years 2012, 2013, 2014, 2015, 2016, 2017 and 2020, accruing $217.56 in penalties and interest. That is on top of the $6,200 in unpaid 2010 property taxes the couple listed in their bankruptcy, with the explanation: “Since we haven’t been paying mortgage, taxes aren’t getting paid.”

04 · The Bankruptcy

On May 19, 2011, Cathy and John Summers filed for Chapter 7 protection in the Eastern District of Missouri. It was a “no asset” case: creditors owed nearly half a million dollars recovered nothing.
The petition notes Cathy was laid off October 4, 2010, and that her unemployment benefits were due to run out the following June. Roughly 83 cents of every dollar owed traced back to the two foreclosed houses.
